I'm also no longer living with dad. I decided the army wasn't for me. Gilly that picture is horrible. How could anyone be so evil. I, living near there at the moment.

Hope everyone is well, sorry I haven't been in touch. He's gone to a new owner and there's nothing I can do, I assume he's found a better owner then my father, who clearly couldn't of give less of a care for his welfare as you can see in previous messages and it was obvious when he told me at the time, the dog was found nearby. My dad and myself got into a fight while I was down and the last time I saw him was last week after work when I met him to watch the football. I just hope he's well, I miss him and I'm sure even after all the things I would have done to that council lady on the phone at the time, in hindsight he may be happier in his new environment, guess I'll never know.

Well I am assuming that Murphy was given to someone else after some time, and is now microchipped to that person from what i understand I think a dog can be rehomed if not found/claimed within a certain time?Last edited: 2016-06-01 07:50:18

I do think the Law is an ass in a situation like this. I know the new owner had him microchipped but if it were me I would do the right thing, an hand Murphy back to his rightful owner.

Remember our wonderful under paid dog wardens are doing the best they can...I do not know one dog warden who is doing this for money....its probably the lowest paid job in local councils...and the first to get cut...please support your wonderful dog wardens..and treat them with respect...Its due!

Thanks Jayne and sammie. Jayne I have taken your advice about asking to send them a a letter, just waiting to hear back from the lady called sue humphrey. Skywalker- top advice thank you, like you said keep calm (unfortunately a bit late, I did get very heated with Sue on the phone earlier) I just hope it's the same with the owners, I am looking foward to writing to them. I would also like to thank Julie for her constant support.

and Jayne is right...keep on good terms with the dog warden.They are your only link to your dog at present. It will be hard but try and remain calm and pleasant when dealing with the authorities...but people find it easier to say no to someone who is angry than they do to someone who is being nice. If I had adopted a dog and then found out he was lost rather than unwanted I would want him to go home.

Sammie, I do not think it helpful to start talking about the new law..there is a 21 day amnesty anyway if your dog is found not to be chipped.
Jsparshott97, doglaw will advise, and please note they have an advice line that charges premium phone rates so it is not as expensive to make the first call as it is to see a normal lawyer. You could also try thepetdetectives.com, they recently helped recover Mickey a Lhasa Apso who had been missing 5 years. I am afraid the dog warden acted within the law, I guess your dad didn't report Murphy missing to the dog warden. The advice to ask if they/the kennels would write to the new owners is good and you should do that. I might be tempted to get his chip details updated to me so that if he ever went missing again he would come back to me...and flag him as missing with the chip company.

Like Julie says Doglaw can reaffirm what has been posted here. Even if you didn't know till now, surely you were breaking the new law by not ensuring his chip was up to date or checking he had one. The law that came into force in April was widely advertised, albeit your dog went missing shortly before when the only law in place was to have a collar and tag. A dog is treated as property in the eyes of the law, and this is the law surrounding it. So it sounds like the the council followed the legislation by notifying the last known address then rehomed. That is standard law, and even if you found him and went to court sadly I doubt you would win so the best advice is to clarify all this with these people as even if you went to court you would need respresentation.

Best thing is to keep on good terms with the dog wardens and kennels if indeed Murphy was rehomed via either and ask them to send a letter onto new owners...it maybe that Murphy has not settled or is too lively for them...But as said by others they have not done anything wrong. Difficult one. If he wasn't chipped to you (although this isn't classed as proof of ownership ) the dog warden was within their rights to rehome him. Unfortunately it happens a lot. A collar and tag can solve so many issues. There are pet lawyers who could give advice. Least you know he is safe.

Hi I am now desperately appealing to anyone that can help me get Murphy back. He was found on the 6th march on fair oak road and was rehomed by the dog warden. Apparently due to legislation I am not allowed to have him back as the previous owner in Harlow had him microchipped, they sent a letter but have had no response from the previous owners. I do have proof he was my dog. Please can anyone help or have any ideas?!

Hya have you contacted your local Dog Warden? And all your local rehoming centres?Did you call the chip company to make sure all the details are up to date also?And they will flag him up as missing.Get loads of posters out in your area ..you can download them from here

Hi Rose, my dad went out to put rubbish in the bin leaving the door open but there's another door before you get into the living room, the wind blew it open and when my dad went looking for him inside he was gone. He immediately checked the village after but murphy had gone.
