our council uses or use to use 2 different kennels miles apart, and it was not unknown for both these kennels not to know what dogs they had........... as SVend says ITS VITAL TO VISIT KENNELS TO SEE FOR YOURSELF.... the romanian dog we have was in manchester dogs home for 11 days before scanning........

Great news... and relieved to hear the kennels didn't put too many obstacles in the way of the owners getting their dog back (once it was clear they had him!). It does highlight the importance of actually VISITING kennels, and not relying on phone calls and verbal descriptions. While microchips help, they are not the universal solution as they can and do fail or move, and are missed much more often than people realise.

brilliant happy ending but it really does make people realise the importance of the microchip, and i still love the old fashioned but easy to read id tag on the collar.

I think that a lovely dog with no microchip or ID tag was looked after and kept safe for two weeks and is happily now back home. Well worth £200 I'd say.

Once they have Jess back, and as long as they have proof they contacted dog warden etc I would try and get the money back from the council...I would write to the Chief Executive Officer of the council. If this is unsuccessful I would go to the small claims court to try and recover the money...it would cost 25 pounds to file a claim online (https://www.gov.uk/make-court-claim-for-money/overview). REading through the comments on Jess' page I think this is a lot of money for her owners but they don't want to ask people for help.

Seems like a breakdown in procedures somewhere but at least a happy ending for Jess and her owners - this is really good news.

I have spoken with Jess' owners and they are going to the kennels this afternoon to pay the fees and get Jess back.
According to the dog warden reports Jess was found in Cudworth which is some distance from Lupsett and is covered by the Barnsley Dog Warden .
However her owners had been calling both the holding kennels for Wakefield which covers the area she went missing from and Cliffe Kennels which are the holding kennels for Barnsley .
It's a mystery how she ended up in Cudworth but even so reports of the description of Jess should have been matched or been considered as a possible match by the Kennels and I suspect when Jess's owners called them they may have just checked for any dogs picked in the WF2 area rather than checking through descriptions and breeds .
Once collected Jess with be going to the vets for a check up and a microchip ASAP.
Hopefully her owners will be able to take the matter further with the kennels and local council who maybe should waive their fees as a goodwill gesture as it seems that records of found dogs may not have been checked thoroughly enough by the kennels when the owner contacted them
Will not move to reunited until owners confirm Jess is back home with them and they will also hopefully take a reunited photo .

As long as you have proof of ownership, ie vets bills vac cards, photos, telephone records etc., I would pay the price then , despite it being a rescue I would go to a Solicitor and seek legal advice.
On Doglost we cant condone illegal practices but paying for her then seeking advice is the way forward.No point in emailing them it might get their backs up ...GillyP is right you will not get fined for not having a chip but you do have to prove you have done itLast edited: 2016-09-28 12:07:43

Patlucky if your dog is found and not chipped it is not an instant fine. Owner is issued with a 21 day notice.

I sent the kennel an e-mail this morning pleading on their better nature. The owner should have had the dog microchipped as per the law; they are on shaky ground if this was not the case. If I was the owner, I would pay the money and get the dog back and then go the vet immediately and have the microchip done.

This all hinges on whether the owner can demonstrate they have telephoned the kennels and/or dog warden on several occasions, and accurately described their dog. If they can, then the kennels or dog warden may have been negligent (or worse), and it does NOT automatically follow that the kennels own the dog now. I would recommend:
(a) owner collates as much evidence as possible (e.g. screenshots of call logs on phones etc) to show they contacted kennels and dog warden, and
(b) owner contacts a suitably competent local lawyer (being able to meet face-to-face is important), with a view to securing an EMERGENCY INJUNCTION in the high court, to prevent the kennels from re-homing the dog. This can be done any time, 24/7.
Once this is in place, they then have time to pull a better case together. It will also show to the kennels and dog warden that they are serious, and may induce them to return the dog. Of course it costs money!Last edited: 2016-09-28 09:47:16 by Svend

Good advice there Mandy. It isn't the first time and it won't be the last. Sadly, when a beloved pet goes missing there is an incredible amount to do and not being able to trust the word of kennels doesn't help.
This example must send shivers down the spines of those with missing dogs.

There has to be one thing to be thought of.
This dog may or may not be micro chipped.
If it is not and owner goes to police there is a £500 fine,
Think I would get my dog and be very quiet.
The law is as it stands rescue owns the dog now.
Get the dog and run would be my advice and if not chipped get dog done.
It came into law on 6th April ALL dogs must be chipped

Once they are reunited I think the owner should do an article with the local press to highlight the need to keep checking and visiting the rescue centres and not take their word for it over the phone - its not the first time whether mistakenly or deliberately a cute looking dog has been rehomed when the owners had already contacted a kennels :-(

The owner needs to contact Trevor cooper at Www.dogkaw.co.UK. they have and advice line which is charged at premium rates so not like a full legal consultation. She also needs to go to the jenbeks, and contact local press.

May I suggest that the owner goes down to the kennels to identify Jess. Take as much proof as possible such as photo's and inoculation cards.

The owner's telephone provider will surely be able to provide a list of the times and dates she phoned these kennels.
Unfortunately she is still on the rehoming list tonight.
I am surprised at these kennels. Apart from allegedly incorrectly telling the owner that Jess was not there, returning her to her rightful owners would free up a much needed kennel space.

This was posted to Jess's face book today.....Jess has been at cliffe kennels in Barnsley since the day she went missing I've rang them so meny times every time they said she wasn't there..we found out today that she's been there 2 weeks and someone has a reserve on her and we might not get her back..it's absolutely disgusting that they saying that I haven't rang them we're waiting on the manager ringing us in the morning if this doesn't get sorted I will ringing the police and doing everything possible to give them a bad name my poor son has missed his doggy and wants her back..please share this and let everyone know what they have done to us......
