Dawn, it must have been a difficult decision for you to leave Sox with her 'new' family. As has already been said, a very unselfish act on your part. I hope they appreciated your sacrifice, which was obviously done in the best interests of Sox. I do hope that she goes on to make a full recovery from her surgery and hope that you might receive the odd update and photo to show you how well Sox is doing. And, well, what's this I hear about the patter of tiny paws?! Bet they're gorgeous. I hope they all go on to have happy and healthy lives. Best wishes to 'mum'!

I feel for you Dawn. As I said to you on the phone only you can make the decision on how you want to deal with this, you sounded so understandabley torn on what to do, and for what it's worth I think you need to be a very unselfish person to come to the decision you have.
I hope everything works out for all involved and I'd imagine there have been quite a few tears shed over this from both sides. Maybe you can ask for the odd photo and update on Sox?
You'll be concentrating on those new babies soon Dawn, any news on that? do we have the pitter patter of tiny paws yet? Please let us know how many new additions there are when it happens, I'd love to know.

Dawn it's nice to hear that you've managed to make contact with the person who now has Sox but sad to hear that's she's undergone surgery on her hind legs. Of course, it may be no more than an inherited problem. My dearly departed Rottie girl suffered from cruciate problems at a very young age and when one of the UK's leading orthopaedic veterinary surgeons carried out the first operation, he found that the cruicate ligament had 'simply disintegrated' and warned us that the same might happen to the other leg, which it did 9 months later. Do you know the details of Sox's op? I do hope that she hasn't had to go through the same as our Heidi but, as you say, at least she appears in be in good hands. I hope that everything goes well for her.

Well, at least it sounds that this person is going to be reasonable about this, she no doubt realises you have "right" on your side.   And she obviously cares about her.   It interests me that Sox, at such a young age, has had these leg problems;  I wonder what has been happening to her???   Thanks for letting us know what's happening, Dawn.   If you're worried about how your other dog will react to a newcomer, I can only say it's surprising how well they do adapt if you're careful to begin with;  he/she will probably be delighted to have a friend to play with, and in my experience two dogs are no more trouble to look after than one, and they do then have company when you have to leave them at home for a while.   Good luck with it all, please let us know how things go xxLast edited: 2010-05-11 02:17:18

I have just spoken with Kay, Lewisham's Animal Welfare Officer about Sox, followed by a phone call to Dawn, Sox's mum. Kay recalls Sox going missing and has said that she will do all she can to help. I have passed Kay's mobile number to Dawn who will call her straight away.

Dawn, this sounds good. If however, they refuse to give Sox back then please please let me know and I will ask *L* if he will write a letter, I doubt whether he will charge for it but if he does don't worry, I'll cover the cost myself if it means Sox being returned to her rightful owner.

glad that although at the moment she isnt in your possession that you know sox is safe and well, i wish you every luck in getting her back. I think that the fact the police wont do anything is riduculous! she has effectively been taken without your consent therefor is theft, if i had bought a car, not knowing it was stolen, i'd be ordered to give it back immediatly! is there a higher local police authority that you can go to? perhaps print off any correspondance you have that shows that you reported her missing and have been actively looking for her. what is the point in microcipping if it means nothing?Last edited: 2010-05-11 02:17:18

Hi sox's mum, I'm actually at work at the moment and can't access my email here, I'm  not actually supposed to be here at all sshhh!!. I'll check my email when I get home but it probably won't be until around 10ish, although it could be sooner.
When I spoke to my husbands friend he was adamant that you are Sox's legal owner and if it went to court his 'new owners' wouldn't stand a chance (his words), so hopefully just the mention of court will be all that is needed.

Looks like some good sound advice and help here, which I hope will help Sox's mum.   My feelings about the non-police action in this case are unprintable.   I know we have had good co-operation from the police in some cases on here, but there are also some lamentable instances where they just haven't been prepared to do anything.   After all, stolen property is stolen property whatever "it" consists of  and I begin to wonder if there isn't a case for naming and shaming, starting with Bromley Police.Last edited: 2010-05-11 02:17:18

Right, I've just personally spoken to my husbands friend as he's not very good a relaying messages. Now, he says that you Sox's mum, are the owner. He went into alot of legal stuff that I really didn't understand, big words tend to fly by me but he said that the fact is, you have at no point relinquished ownership of your dog and she therefore still belongs to you.
I told him I assumed she had been rehomed privately rather than through a shelter due to her chip and he said that if the original finder could be found they could be charged with theft by finding but this is apparently a dodgy road to go down as its hard to prove, but thats not really the problem is it, you need her back from the people who have her now, and apparently, because you never willingly gave your dog to them or anyone else they too can be charged with theft (not sure how that works).
He suggested taking the 'new owners' to court although he realises this can be expensive so says for now, you need to try and talk to the 'new owners' either yourself or through someone else and mention court, this may change their minds, but to keep things civil.
He has told me that if you need to speak to him for any further advice on how to go forward then email me at debbijayne@hotmail.com and I am to pass his number onto you. He even mentioned representing you if things went that far.
So the upshot is, you are still Sox's legal owner.

Hi Sox's mum. I so sorry to hear about this awful situation. I wonder whether Kay, Lewisham's Animal Welfare Officer might be able to help as I know she was actively looking out for Sox and clearly recall having a telephone conversation about Sox when we were also looking for Timmy, the terrier cross that went missing from his home in Catford. Unfortunately, I don't think they are duty now until Monday but certainly worth a call. What a crazy situation - what's the point of microchipping if the authorities won't accept that as proof of ownership. I'm keeping my fingers crossed for you that things can be resolved.

I remember Sox from last year, especially the comments about her birthday.  I just telephoned Petlog and they won't give out any legal advice whatsoever, they just advised to contact the Citizen's Advice Bureau - you probably know this already.  I hope that the 'new owners'! have the decency to hand Sox back, perhaps they could put thereselfs in your position and maybe their conscience would get the better of them.  Wishing you the best of luck (it will all depend on the sort of people that you are dealing with).  Kind regards JulieLast edited: 2010-05-11 02:17:18

I know it would be difficult but I wonder if there is a way to find out where the 'new owners' bought Sox from? I'm assuming she wasn't re-homed through a shelter due to her chip. If this person could be traced then surely there is a case for 'Theft by finding' here, it could just get the ball rolling?

Hi, I thought a microchip was definate proof of ownership, especially if all details logged are still current i.e address, phone etc. I think the family should be really assertive here with the police - it IS their responsibility to return 'property' to its rightful owner. The 'new' owners only have redress with the person/rescue they got Sox from- I don't think they have any legal claim to this dog. Can't Dog Lost help here?Last edited: 2010-05-11 02:17:18

I live in Totton which is near southampton, not a million miles away from Bromley. I dont know the circumstances of her dissapearance, but know that one of the main dog nappers routes goes from southampton to bromley area and vice versa probably. I saw what I considered to be a suspicious for sale sign in one of my local pet shops. It looked so dodgy I copied the details and looked on doglost for any staffies fitting the description. There is no photo or description of animal unfortunately. The advert is written on a scrap bit of paper & reads as follows. for sale. 8 month old staffie bitch ?250 phone 07901 963023. That is ALL it says. A mobile number too. Could owner give them a ring? Or anyone else who is missing a staffie of about the right age. Call me over cautious if you like but I now dont trust anyone after losing our own dog to thieves. Might be a genuine advert but it doesnt look like one to me. Spoke to Soxs owner last night and they are doing a fab job, poster up around the local area, in shops, woods, parks etc - so hopefully making Sox ultra hot and a reunited soon!!! Also Soxs is in the Bromley News Shopper this week and will be trying to place a advert hopefully in the Kent Messenger! I will print off a poster and take to the Big Asda tomorrow evening and have also advised to poster Swanley, St Mary Cray and St Pauls Cray.
