You are all so lovely. Thank you. x Esther, you are so right. I tried that angle too, but you know what, even when I asked about people on the tracks, I was told they "are insured". How awful is that? It should be about prevention rather than pay-out. And Network Rail has never admitted our success. They make out it was due to signs of trespass. Well who kept telling them there was trespass???? We did! We know the truth, that's what matters. I also think the petition's thousands of signatures had something to do with it (paper & online). So many poor owners going through this same thing; sometimes it is all too hard to bear. We just have to keep trying for other parks now. Bless you all for caring and supporting us. And a bark from Cassie! :-) xxx

Kimmybear, since reading about your success yesterday, I have not been able to keep you and Cassie out of my mind. I have been thinking, probably thought of by lots of people, but here goes. Network rail seems to accept they have a duty of care to people, surely a person can not just be thought of as a physical being. Surely to cause a person mental distress is also within the bounds of their responsibility, which to lose a dog in this way will clearly cause distress, especially as she was your assistant. On another note vegetation is surely not enough to stop a small child. Kimmybear, I am so pleased for your success. Cassie will always be with you.

Here is the story from the Star newspaper:
A deaf woman whose hearing dog was killed by a train when it ran on to rail lines near Harlow station has won her five-year campaign to have fencing erected along a stretch of track running near Harlow Town Park.

Kim Herbert, 55, of Altham Grove, said she was overcome with emotion when she saw Network Rail had erected the barrier.

“I was gasping for air and crying at the same time,” she said. “It was the sheer scale of the thing that knocked me off balance and the fact that we had won.”

Ms Herbert’s dog Cassie was killed after running on to the line while the pair were out walking in Maymeads Marsh in 2009.

Soon after she launched a campaign and online petition calling on Network Rail to improve safety by fencing off the stretch of track running between Harlow Town station and the Templefields industrial estate.

At first Network Rail refused to erect barriers along the path, insisting that trackside borders were fit for purpose.

Ms Herbert said: “Ever since I started this campaign Network Rail has been saying that public safety along the track was adequate, that they had no duty of care to domestic dogs and the lack of fencing was lega, despite there being no physical barrier to prevent access.

“They said vegetation was sufficient. They kept saying it was fenced with a post and wire which was very much invisible and did nothing to prevent people from accessing the track either.”

Last year Harlow Council installed safety fencing along one of the most dangerous sections of pathway.

Then around three months ago Ms Herbert was advised during a Town Park Users Group meeting that the council and green team volunteers had been asked to lower the water levels in the streams to enable Network Rail to install fencing.

“Since then and not wishing to get my hopes up, I checked periodically for this fence to appear. Last week when I decided to have another check I was totally, totally stunned.

“I went up the railway bridge and looked over and couldn’t believe my eyes. What I saw was about a quarter of a mile, possibly more, of palisade fencing - exactly what we had been asking for and been constantly denied.”

Network Rail has now erected safety fencing on both sides of the track and behind the streams”.

Ms Herbert added: “This part of the park is so beautiful and it was our favourite place but after what happened, it became the worst place on earth. I couldn’t even look there without remembering the horror of that night.

“Now, the whole atmosphere has changed; there is a kind of peace there once more. I just wish it didn’t take the death of my beloved dog to make this happen “

A Network Rail spokeswoman said: “The reason we installed the fencing was because we inspected the area and found a change of land use and signs of trespass.

“The land next to the original fencing was previously scrubland but is now being used by members of the public which is why we have installed new fencing on this stretch of railway..

“We have replaced the post and wire fencing with new palisade fencing at Harlow Town station.”

It has been four and a half years since I lost my beloved Cassie. Finally, Cassie's Fence Campaign has really won! The railway track has now been fenced properly by Network Rail. The fencing is exactly as we requested, metal pallisade and it's at least a quarter of a mile on both sides on the track, even behind the streams. It has been such a roller coaster and so emotionally hard because its a constant reminder of that fateful night when I lost my reason for living; my Cassie. I first saw the fence two weeks ago, but I needed to wait until I knew it had been done properly before confirming. There is still a part further up, not done by the marshes, but the main part is now safe and secure. I was so emotional when I saw it. I couldn't believe what I was seeing. A huge weight has been lifted and Cassie's park is beautiful once again. I will never forget the horror of that night and I would give anything for it never to have happened in the first place. I have to trust there is a reason and my Cassie has now saved many lives. I can now walk our Misty there knowing we are safe, and, with Cassie by our side. Thank you to all of you who have supported me throughout this journey. You helped give me the strength to get through. May God bless you.

AN animal lover has won an “important victory” in her two-year battle to get new safety fencing erected along a dangerous railside pathway running through Harlow Town Park.

Kim Herbert (53), of Altham Grove, lost her beloved ‘hearing dog’ Cassie in 2009 after the pet ran onto the line while the pair were out walking in Maymeads Marsh.

The distraught dog-owner launched a campaign and online petition calling on Network Rail to improve safety by fencing off the stretch of track running between Harlow Town Station and the Templefields Industrial Estate.

But after Network Rail refused to erect barriers along the path after deeming existing trackside borders “fit for purpose”, Harlow Council has now stepped in, installing new safety fencing along one of the most dangerous sections of pathway.

Kim said: “Although this is not completely fencing off the railway line, it does prevent access to the line underneath the bridge, which is where my Cassie was killed and where dogs are still getting onto the lines.

“The battle with Network Rail continues but I am so grateful to Harlow Council because it has stepped in where they failed. It’s a small contribution but it will make a big difference.”

Cassie’s Fence petition has received over 7,500 signatures and has become so popular it has now evolved into a national campaign calling for all tracks to be fenced off in the UK’s public parks.

“This track is still by no means safe but with the council’s help and Network Rail’s attempt at a makeshift ‘tree-barrier’, this is a big step in the right direction,” Kim added.

“But I’m in this for the long haul - I won’t give up until the line is safe.”

Also having lost my own hearing (On a temporay basis) due to a bad infection it gave me a big incentive to support "Hearing Dogs" which I do on a regular basis. Once again WELL DONE Kimmybear. Well done Kim,It seems like only yesterday when i got the text from you that night to say Cassie had gone missing not over 3yrs ago. I will never forget the heartache we all suffered, but it was not all in vain!!! You have campaigned hard for this fence and it was promised by network rail, i was there at the meet, but then they went back on their word. Good on you for not giving up, i know how much effort you put in,it was almost ruining your life at one stage, it was all you would talk about, and now its come true, thanks to your hard work. We did say it would take a child to be killed there before anything would be done, but thankfully thats not happened. The money they got from the lottery fund should be used to fence off more of the track but i guess for now we should be grateful that the worse bit is being done. If a dog can get onto the tracks then so can kids.ALL the tracks near park ares should by law be made safe, they make enough money to do this and the trains now go at such high speed nothing stands a chance if it ventures onto the tracks.WELL DONE i bet your one happy bunny!!!! Cassie, your mum and i are very proud of you.xx

CASSIE'S FENCE IS ON ITS WAY!!!!

The Council is going to fence off the access to the railway tracks by the bridge! This line will still, by no means be safe and the battle with Network Rail continues, but this bridge area is a danger hot spot and that is where I lost my Cassie. That is where the majority of dogs access the line. That is where kids have also accessed. But, no more. The Council has stepped in where Network Rail has failed. Its only a small area, but the most important part.

Thank you to those of you on DogLost who have supported me and been there for me ever since that dreadful day. Thank you from the bottom of my heart. And a big kiss from Cassie in heaven.

We still have a long way to go, but with this area fenced, I feel like I can breathe again. I have to wait 2-4 weeks and then it should be up.

Thank you; many of you are carrying your own heart breaking stories, in one way or another, so please know I am truly grateful. There are two petitions now: 1) My Cassie's Fence - local. 2) National Campaign for Cassie's Law for the whole UK - change of law to enforce Network Rail to comply with procedure. I've dropped DogLost into so many communications as it was this site and the people on it, that got me through and I will never forget that. Way too many owners out there now going through the same thing. This mission has picked me and I can't say no. As I write this, our local paper has just arrived - big article in there too! There isn't much i can do to help loved ones find their lifelong friends but i read this regularly and look out for missing dogs in my area.. To read this and the comments and help that people have put, i have faith in mankind once again. There are so many heartfelt people out there and yes, unless you're a dog lover it doesn't quite make your heart ache like it does when we lose our furry canines. I wish Kim and her family love and peace, at the moment it is too raw, but the love you hold in your heart will help heal another dog, maybe a rescue dog, grief needs companionship and dogs offer just that xxx Thinking of you xxxxLast edited: 2010-05-11 02:17:18

Every now and again one of these threads just catches your breathe and your heart and this is one of them .. although I never met Kim or Cassie I just knew from the first post that this dog was incredibly loved.  I too have been in tears over this.  I just so wanted this to be a happy ending, but at least she is home with Kim now.  Forever in hearts and minds .. rest easy dear Cassie. Oh Kim - every time I read Cassie's thread - my heart simply breaks for you.  This tragic incident has affected me more than I thought possible, seeing as I never met Cassie.  I think it is because I feel your sense of loss and anguish - your grief is palpable and so very raw at the moment.  I have had to stop reading this at work as my colleagues kept asking me why I was in tears ... not something easy to explain unless it is to another dog lover, let me tell you. Cassie is home.  We collected her ashes this morning and as soon as I held that precious box, I knew it was my baby.  We are reunited forever.  Because we were not allowed to see her poor, battered litte body, they cut some fur off for us and we have this now too. Cassie is now whole and in heaven with my Dad and our other animal loved ones. We are so fortunate to have been able to retrieve her body. I so wish everyone who loses a dog in this way could have this, but sadly, I have learnt it is simply impossible in most cases and it is better to leave them where they are, as they are, to go back to God.  God always knows where they are. They say God only gives you the pain you can cope with; I think He knew we couldn't cope without finding Cassie so He sent Brett, the railway worker.  So wish she was alive, but at least she is found and finally home.  You have all helped to bring her home.  Thank you so much, God bless you all. I went with Kim and her mum to Resting Pets near Ongar, and would like to say that they were so good to them, and how we are all pleased to be putting Cassie to rest properly.Thanks must go to Jennie who works on the railways and got in touch with Nigel who was the man who saw Cassies body first, when all the confussion took place as i was sick. But it was the call i receieved in the early hours that lead us to closure. A young man of only 24yrs called me to say he had seen Cassie on the side of the rails whilst working, he got cassies collar for Kim and then he and his workmates went to recover her body. Kim had already given him a small something for returning Cassies collar,but not knowing at the time he would go on to get her body for her. Kim wanted to give him more for what could not have been a pleasant job , i got in touch with him and quote from his text "your more than welcome. All that matters is that Kim can now say her goodbye properly. We honestly dnt want no more for it. We didn``t want that twenty pound but tell her we have bought some beer for a christmas drink." so a very big thanks to Brett, his mother should be proud of such a lovely young caring man. I had a lovely email from Kim today, and she has asked me to post this on Cassie?s page to let you all know as each and everyone of you has provided Kim and her mum with so much help, support and kindness for which they are so appreciative and grateful of?..its has meant so much to them.   Yesterday they had a call from another rail worker who had also seen Cassie on the railway. He knew it was her from her posters, she was totally recognisable. He got Cassie?s collar and met Kim last night as he started his shift. Although very sadly most dogs cannot be recovered from the railway, this man said Cassie was collectable and bless him; he went and got her for Kim and her mum. He?s a total gem and a very kind man; he did this all in his own time because he desperately wanted to help. Cassie will be cremated and her ashes returned to Kim and her mum?..so Cassie will finally be home. Please, please would everyone who helped by putting up posters start taking them down for us now. This is so hard to write.  I knew in my soul she was dead that night at the river, I saw the train that hit her, I screamed her name and felt a stab in my heart. She never came back because she couldn't; I knew she'd never leave me.  But we had to have hope and we thought she couldn't get through to the railway line, only a few yards away, as there was fencing. But now we know for sure, and as Lindsay wrote, Cassie we have found you.  You are okay now.  We love you more than life, more than anything. You are our whole world. We will be together forever on earth and in heaven.We are overwhelmed with grief but also with the love that each and every one of you has shown us.  Without all of your love, sweet messages, and support, this whole thing would be even harder to bear.  Please know that I asked God to bless you all for loving our sweet baby.  My Mum and I thank you so sincerely.   Our dear vicar Lynn is going to do a little service for our Cassie, which is lovely.  Thank you to Jennie for coming round last night - you have helped so much.  Netty you are Cassie's Auntie forever.  We love you dear people and your babies. This has been the worst news possible, we had such high hopes after "sightings"  but when we saw the dog everyone thought was Cassie and saw it wasn`t, i think in our hearts we knew. I am so gutted that i wasn`t able to help Kim when the phone call came through, i feel i let her down. Kim and her mum have been round tonight and we talked of Cassie and my gsd went to Kim and nudged her arm and kissed her then was laying on her back, Kim said it was just like Cassie would do. Sasha never kisses people like she did and i think it gave Kim some comfort to feel as if Cassie was sending a mesg through my Sasha. Kim and her mum gave Cassie the best life she could have wished for and i know they will after time give another rescue dog the same. Am absolutely gutted to see this.  I had been thinking of Cassie and her owner ever since she was posted on here and especially in all this dreadful wet weather..  To lose a dog is soul destroying and not knowing where they are. How terribly heartbreakingly sad. Been putting up posters in Bishops Stortford & Sawbridgeworth in Hertfordshire - we are on the border.  Lady found me and took me to her garden - a big dark dog was there last night but she couldn't tell if it was Cassie.  She's says its possible.  She is postering alleysways into Pishobury Park near where she lives and going to look for the dog again tonight. I have just got off the phone to Harlow Star and Dan Phillips on the news desk is going to run a story in this Thursdays Star, will send  a photographer to Kims to take pictures of Kim, her mum and a picture of Cassie, which is a result as have always told me they don`t do stories on lost dogs. I told him Cassie was her hearing dog although not officially trained. I have also tried the national papers but not interested at all. But lets hope we get some leads from the story.Last night was the first night since Cassie went missing that i didn`t go out looking and sods law its been the only night it didn`t rain!!!!!!!! Thank you everyone!  I have taken Mum out and we have driven putting up 150 posters around Epping, Coopersale, Epping Green, Jacks Hatch, Savoy Wood, Parndon Wood Nature Reserve, Staple Tye shopping centre, Milwards, Posters are laminated so they should keep - unless someone pulls them down. The reason I wanted to do Epping is because a little Jack Russell was stolen last year called Poppy and there were connections with Epping thieves - Poppy was finally returned after many weeks in a cloak and dagger deal and dyed all black! (So I am told). I found a lovely policeman in Epping Police station who is putting Cassie's picture up - he was so kind I was genuinely touched and pleased that he is in the police force.  Someone has been pulling down posters in the park near where I live - it is not the council or utilities people. I have just come back from looking around for Cassie and the "stray", and went to tell the lady in Greenhills that put the chicken out, that it wasn`t Cassie, we were not going to say because we thought we would get the stray caught. but decided that was a bit unfair on her .But on talking to people in the area it turns out, there are two dogs that roam that area, both belong to people but keep escapeing from the houses nearby. I did find it hard to beleive cos this one was so skinny and scared,and looked like it had been sleeping rough, either that or its owners should not be keeping a dog!!!!!!! Lots of good ideas being given to me, ones we have tried before when dogs have been lost, and we have had no joy, but are always worth trying again as circumstances are different with Kim and Cassie, so please try them.. As to people asking where to look, she could be anywhere if she was stolen, or bolted because she was spooked. It was such a dissapointment to find the dog seen around Greenhills was not Cassie, but if people catch it thinking it is then it might find its way back home and someone will be very happy, but the poor thing does need to be got out of this terrible weather. I picked June, Paul and Buddy up as it was raining so hard, we went back for a cup of tea, when a call came through to say Cassie was at the stow, but on speaking to the caller again ,it sounds like the one we were trying to get earlier.I think we are going to try going back in the morning and set up a regular feeding pattern to gain its trust, it came very close to me, did as advised but ate all the food and was off.!!!! Back to the drawing board so to speak.  Cannot thank all these lovely people comming out in such terrible weather enough, but please continue doing so for Kim.xxLast edited: 2010-05-11 02:17:18

 I had a thought, My Mum, Netty and I have tried to catch this poor other dog, who looks almost exactly like Cassie, but much more white on its nose.  Netty got the dog very close with food but it is VERY wary.  The Dog Warden probably could catch this dog with a net or whatever they use (although it has a full tummy right now!).  Maybe if we all phone the dog warden he/she will take more notice and go and catch this dog?  At least this dog can be found (Border Collie lady - this may be one for you?).  She does have a collar, but appears to have been roaming for a while. Got a call 8.00am sayingshe was in the Downs next to Greenhills.  Got there and found another dog, with RED collar, VERY similar to Cassie.  What a co-incidence! Trying to get her.  Can you see if anyone has lost this dog?  Skinny, I think it is female.  Been there for a while - possibly a few weeks!  One man said so. Is it at all possible to do BBQ's in the sighted areas tonight and all day tomorrow?   This method has been very successful with other lost dogs.  Anything lovely and smelly to the dog should be cooked .. sausages, meat .. Owner and friends of Cassie should just sit and quietly chatter around the BBQ .. if Cassie shows herself you need to ignore her (however hard that seems) and continue your chatter quietly (maybe throwing in some very quiet mentions of her names or other words that please her like 'walkies' or 'sweety' or whatever words you think she really gets alert to normal) until she feels safe to come closer .. if you react it might make her run and hide more .. Have spoken to two boys and their mum in Greenhills.  They are totally convinced it is Cassie and say she is wearing the right collar etc.  They have put food out for her and she was lying in bushes opposite their house this morning.  We have scented the area and so many lovely dog owners who know Cassie are walking their dogs there, so Cassie may smell these dog friends and stay in that area.  Please pray that it is her for me.  With love and gratitude to each and every one of you dear, dear people.  Kim & my Mum xxxLast edited: 2010-05-11 02:17:18

If a friendly postman isn't an option could a group of people be mustered with 100s of the smaller posters to be delivered door to door in the surrounding housing areas?  Me and Gill did this early one morning when Bart went missing.  It got alot of interest/help and certainly got the word around.    It will mean someone doing tons of printing (took me about 3 hours to do all we posted).  I just wish I was nearer.   PS  I could do some printing .. but would have to post it to someone in the area, which may cause too much delay - let me know.Last edited: 2010-05-11 02:17:18

 As Kim has said we have been out postering around the surrounding areas to Greenhills, until we ran out of posters, i am laminating more as i write. If any one lives in Staple Tye, Sumners, Katherines or any areas further out if you could poster these areas for us it would be great, please put on here where you have done so we can keep a track of what still needs doing. If you have a car please put one in your car window, the more people we reach the better. The man who phoned met us in Greenhills and showed us where Cassie went and seemed 100% certain it was her, so lets keep our fingers crossed.!!! Kim and i will be out postering again tomorrow ( or should i say later today) after i have had my swine flu jab first thing. Thank you so much for all the hard work you are all putting in it has been noted. Netty & I have been out in the rain putting up posters, hopefully they will remain okay as we got them laminated.  Also, today I took my Mum out in the car and we drove to Sheering, Grange Paddocks at Bishops Stortford, some tiny villages on the way and also locally.  We did Greenhills this morning and that's when the man rang afterwards.  I just hope it was Cassie - he definitely saw a dog like her and if it was her, at least we know she is still local.  I am praying it is her.  Once again, I cannot find the words to express my sincere gratitude to all of you.  Please know that in my eyes, you are all angels.  Kim xLast edited: 2010-05-11 02:17:18

Does anyone know a postman who delivers to houses near the area she went missing .. would it be possible to sweet talk him into popping small posters through householders doors to raise awareness.  Obviously this does mean tons of photocopying .. I did this with my friends missing dog 'Bart' and it got a huge response from locals all offering help and and 'eye out'.  I think of Cassie alot .. hope she is found asap.Last edited: 2010-05-11 02:17:18

Thanks Michelle and June have seen posters everywhere today brilliant work. THE POSTERS ARE WORKING< i have just had the first call from a lovely man called Alan, who said he saw Cassie yesterday morning in Greenhills, ran off towards the wooded area. This is where Isac was hidding when he was out for 8wks so fingers crossed . Kim is out getting more posters done but have passed on the mesg. is on her way round here and then we will make our way over there,. To cover a wider area, I've just emailed out Cassie's poster and details to all Essex DW's and stray holding kennels etc, that I have in my contacts list. I think someone has Cassie.  Lots of people know her and no one has seen her, she knows her way home.  She didn't run away from me; she was walking in front and turned the corner as if going over the railway bridge and just vanished in a minute.  We even dragged big sticks through that green pond, I was so scared,  But I know she wouldn't have gone in, I was just losing my mind. She has in the past thought it was grass but she knows different now after falling in twice 4 years ago, and won't go in it. I am so distraught. My poor Mum is so upset - she is elderly.  Our hearts have been ripped out.  I am worried she has been taken to another town or something. Kim and i have just got back indoors from postering the area around the river and along the main road from the training place down to the station. We gave posters to all the black cab drivers down the station, and also went into the station and there have been no reports of any dogs on the line. Kim would like to thank everyone who has been in touch and offered help in looking and postering for her. I'm so sorry Cassie is missing. I understand you and maybe Netty spoke to my boyfriend earlier, he is a black cab driver. The drivers you spoke to were all very concerned and are all looking for you as they drive around Harlow and we will go out in the morning and look on foot as well. have been out looking along the river for most of afternoon, but no luck. At the moment Kim and i are printing off loads of posters and putting into pockets and also laminatting some. Have contacted all vets etc, will get out posters to them tomorrow. If anyone can print off posters and put them up in their areas that would be great. Advert will go into next weeks star if Cassie has not returned. We are almost certain someone has taken her, because talking to Kim about last night i said i heard a mans voice calling Cassie from the bridge, but Kim being deaf was unaware of this, although when i turned up last night i asked her who was it with her but she was so distressed and it was dark she couldn`t have understood me.Last edited: 2010-05-11 02:17:18

Kim is a very good friend of mine and i was out looking for Cassie with her until the early hours. Kims dog Cassie is her life and she is really lost without her and is worried she may have gone into the river and as she (kim) is deaf would not of heard her. please, please help her in the search for Cassie. I have texted everyone i know to help look out for her. She was last seen at the foot of the bridge that goes from the river to the town park, and as Kim says this is not like Cassie not to return to her or make her way back to the car, or possible she would have found her way home. As you can see from photos Cassie has very large ears and is long legged i would say she is a border collie cross. She is a rescue dog and likes to chase things and barks around people and other dogs, at the same time is quite "shy".
