- Thanks everyone for the advice greatly appreciatred. Owner has been sent the links when we contacted them on 26.10.15.
As soon as we have more news we will update you. - 2015-10-29 16:02 NickyB
- I found a dog and asked my vet of 10yrs to scan. they would not reveal details to me - so I had 2 choices leave it with them and either they would mke contact with owner, or they would hand to dogwarden, or take dog home inform dog warden etc. so I wrote to royal college of vet surgeons phone 020 7202 0789.
they replied with a 2 page letter and a sheet headed RCVS POSITION - THE ROUTINE SCANNING OF DOGS AND CATS FOR MICROCHIPS
and a sheet headed J. MICROCHIPPING PARTS 1. TO 7.
- they enclosed Annex J - their paper headed microchipping which I expect can be googled
Annex J microchipping
5. ownership dispute
an ownership dispute may arise where a client presents an animal with a chip registered in another persons name. with their consent both parties to the dispute can be put in touch with each other.
6. if a client declines to consent to the release of his name and contact details anddetaisl of the animal and microchip a vet should breach client confidentiality to pass necessary info to petlog reunification service. if registered owner declines to consent to the release of his name and contact details these should be known to the petlog reunification service
7.petlog reunification service will then seek to reunite the animal with the registered owner or update the relevant database
etc etc etc
another sheet headed RCVS POSITION
.........it was not the role of the veterinary surgeon to "police" their clients.
if a pet is found to be registered with a different owner from the one presenting the animal this would raise the question of whose responsibility it would be to sort out the problem -IT IS NOT THE ROLE OF THE VET TO ACT AS A POLICE OFFICER

- Have there been any more updates on this case?

- Bit of info that has come via our facebook group. Border terriers Lost & Found. Apparently this company specialises in all things animal law: https://www.facebook.com/clivereesssolicitors

- They could have bought him in good faith, but that does not mean they can keep him. Much better guidelines are needed for vets...unforunately the micro chipping law is to make it easier to deal with stray dogs, not for the benefit of dog owners. Vets or owners should call the police and report Charlie stolen...but I am sure Doglost and Debbie Matthews will have given them good advice. I think I would be tempted to stake out the parks local to the vet he was taken to to see if he can be spotted on a walk.
- 2015-10-27 15:46 Kat
- A cat was taken into Sheffield PDSA for treatment & for some reason the vet scanned it. It flagged up as missing, the vet called the police & the people who had the cat were charged with theft by Finding. Surely this is the same thing!!!!!!!!!!!
- 2015-10-27 12:01 LindaT
- Very odd! I hope this gets sorted very quickly, it otherwise seems to make a mockery of the whole microchipping system!
- 2015-10-27 11:32 twoDs
- Shared agin in all the BT groups on FB including Border Terriers Lost & Found - will do more tonight.I do hope this is sorted and he is home soon
- 2015-10-27 10:29 Rose
- Somrthing is very odd here. If the m/chip was flagged up as missing surely the vet has the responsibility to contact the DW, not to ring the original owner telling them they have scanned their dog but you cant have it back!! What is the point in having dogs chipped? I believe that the police can get the info from the vet. So hope this is resolved very soon x

- Shouldn't the present 'owners'of Charlie be questioned about how they came by him? They must of either found him, stole him, or illegally bought him. So none of these factors are legal! Surely the vet is aiding and abetting these people by witholding information!Last edited: 2015-10-27 09:51:36 by Ellie

- Surely if we are being told to chip our dogs it must mean because we are the legal owners? I do hope this gets sorted...I feel sorry for both parties to be honest x

- I really hope this gets sorted out. I see very little point in bringing in "compulsory microchipping' if situations like this occur. My dogs are chipped in the hope that if they ever get lost they will be returned to me whenever they are found, despite how long that may take, as I am their registered owner.

- Have had a long discussion with Jane and advice has been given which is going to be followed up. Thanks Debbie Matthews (Vets Get Scanning) for also sending info to Jane. x
- 2015-10-26 21:21 kaye
- Surely if Charlie was registered as missing with the chip company the vet has a moral responsibilty to at least hold Charlie and question how he came to be with the current people that have him, but to contact the owners and say we have scanned your dog but you cant have him back is pure evil

- Another family member has posted the following on the fb thread on my page:
Charlie was a HUGE part of my mum in laws life and he is all she talks about even though he's been missing for 2 years. Because she has Alzheimers it's like she lost him only yesterday. Having him back will bring her so much joy. Don't worry about him being cared for as Jane Fleming cares for my mum in law and was doing an excellent job caring for both of them. Let's hope for a happy resolution xxxx - 2015-10-26 20:06 Majorjet (Jan) - Area Co-ordinator - Liverpool/Merseyside, North West
- Janey who registered Charlie left the msg below on my fb page, I have not long got in but will speak to family direct. Thank you to everyone who has posted in the fb post in response:
I don't know if you'll remember but my Mum's dog went missing 2 years ago (28th Oct 2013. I received a call from a vet in Formby saying someone brought him in on Saturday. They tell me they can't give me their details and I would have to seek advice about getting a court order to get him back.
Do you know anything about what I need to do? I would really appreciate your help.
My Mum has Alzheimers and the one thing she remembers is Charlie...it would make us so happy to get him back. I am very grateful to the people who have been looking after him. Thank you x - 2014-01-05 12:24 Layla Streeton
