- TED is back with us :-)
On the 18th of June 2014 Hounds First posted and registered a dog as stolen. This was following a situation wherein a foster carer refused to return a foster dog to us when asked, despite breaking our foster terms and the Trustees having welfare and home suitability concerns .
On the 24th June after numerous attempts to regain custody of the dog the trustees started legal proceedings in order to settle this matter.
Today during a hearing at Brentford County Court in the presence of the District Judge it was confirmed that there was never any doubt that the dog was, and had remained property of Hounds First Sighthound rescue and that the foster carers attempt to keep the dog was unlawful and she was ordered to return him forthwith.
The judge stated it was incredulous that the foster carer disputed our claims to owner ship, that she had provided no evidence at all to show that ownership had transferred and nor did the judge believe that the (former) foster carer genuinely believed that. In contrast she commented how our paperwork clearly showed that ownership was ours.
As such an order was decreed today that the dog must be returned and our resulting costs met.
The dog in question is now back in the care of Hounds First and once he has been reassessed and immediate issues addressed we will be welcoming applications for him.
Hounds first are grateful to people who have expressed their support during this case and we hope that this landmark case sets a rescue precedent and prevents similar situations occurring for any rescue in the future.
Please note that following this statement the trustees will not comment further on specifics or personal details of this case.Last edited: 2015-01-14 21:24:07 by rachelhayball - 2014-06-29 10:58 Maryann
- Any updates on Ted? Hope he is safe

- As Racheal has stated there is more than just the taking of this dog which will have to be a civil dispute however the other actions taken are a crime hence the CRN.
Thanks for offer but I do already have a couple of names officers in the met that I deal with and one is already helping and advising.
If helpers will just poster to spread the word it will help as need the person with Ted to realise how serious this is.
Updates will be put after checking first with the police force that are dealing. - 2014-06-22 08:30 rachelhayball
- A crime number has been issued. York and the met police are investigating 3 different crimes in this case including impersonation of a police officer, intimidation of a witness and others.
With all due respect Lozza we have been advised by the police and legal team to stick with current working police officers and keep as much of the case as possible as confidential as we do not know who is working with the people who have committed the offence. - 2014-06-21 20:44 Lozzas Lurcher Rescue
- CJ Police Contact Co-ordinator, I think reading between the lines this is being treated as a civil dispute and does not have a Crime Ref number attached to it, ie there is no wanted suspect for an outstanding crime as no crime has been committed, so the dog is not STOLEN...? People that dont know,CAD numbers are nothing to do with crime numbers, they are simply a reference number given when someone calls into the police. If it is something that requires police assistance the cad number gets updated as a permanent record of what was actioned. If I am wrong, I have already requested the CRN number and the suspects name and the borough the crime was committed when it was shared on my rescue page but after I asked for that information for the second time, someone deleted the post.... I can get these details put on the relevant intel briefing and also circulated amongst all my ex Met colleagues....Please someone email me at lozzaslurcherrescue@hotmail.com with that info if assistance is required. IF the police are not treating it as a crime and it is a civil dispute, then this dog post has to reflect that the dog is not Lost or Stolen, technically, until a civil court decide the outcome of ownership. Once legal papers are served for the civil matter and on the first hearing, if the other party doesnt attend, then you could technically class the dog as lost, but as it stands at the moment, if the police have spoken to the other party and have confirmed this is a civil matter, then they are happy that no crime is being committed and this lady can continue to keep the dog until such time, a court says differently.Last edited: 2014-06-21 23:53:14 by Lozzas Lurcher Rescue

- Are you sharing using the FB link ? It was entered as female then corrected but the FB link is remembering the incorrect first one and not sure if can be changed and is a problem we have spotted in the past.
if you right click the web link then paste to FB using either the page link or poster link it should then state male. - 2014-06-21 00:55 debbie
- Just shared this poster & it's coming up in description as Female.

- Ted bumped due to extensive police involvement in the hope it will be spotted by whoever has him at present.
- 2014-06-20 18:20 CJ - Police Liaison & SE Regional Coordinator
- there are now 3 police forces involved in this case and all are keeping records and giving CAD numbers- however it is difficult to prove theft as the dog was handed over even though only to foster.
HOWEVER the rescue have already sought legal advice and if necessary will take this matter to a civil court if not returned.
From the paper work they hold plus fact dog is chipped to them they have much more chance than the person keeping Ted.
Would suggest they see sense and return him or make contact ASAP to avoid further court action. - 2014-06-20 14:40 rachelhayball
- It is now believed that the person who had Ted has passed him onto another person as she is believed to have gone out of the Country on a trip.

- I live by the rugby ground in Twickenham TW2, so will spread to word locally when out walking. I also foster for a rescue and know 2 or 3 other immediate fosterer's who I will ask to keep a look out for poor Ted. I will print off posters and place in local walk areas too as being a sight hound, he is easy to recognise. I am also happy to follow up local leads if needed... (no punn intended!). Fingers crossed for a speedy recovery.

- Doglady- the foster carer knows that she is no longer authorised to have the dog. She agreed to hand over the dog, she then didn't turn up. Yes her home, work and parents have all been visited. This is now in the hands of the police who are taking it very seriously. We cannot give any more information while the investigation is ongoing.
